The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. In the event arbitration is not permitted by applicable law, the parties waive all rights to trial by jury and all rights to commence or participate in any class action, consolidated, representative, or class proceeding.

Any modification to the dispute and arbitration provisions shall not apply to claims arising prior to the date of such modification.
